Please read these terms carefully before using FameForecast.
The FameForecast platform is operated by Hawkins Business Architecture Pty Ltd (ACN 693 911 616) ("the Operator"), a company incorporated in Western Australia, Australia. Hawkins Business Architecture Pty Ltd operates the platform under an exclusive commercial license from FameForecast Pty Ltd (ACN 693 750 177), which owns the underlying intellectual property and technology.
All commercial contracts, agreements, and transactions entered into through this platform are entered into with Hawkins Business Architecture Pty Ltd as the legal contracting entity. Any legal notices should be directed to Hawkins Business Architecture Pty Ltd at contact@fameforecast.com.
Welcome to FameForecast! By accessing or using the FameForecast website and services (collectively, "FameForecast"), you agree to be bound by these Terms of Service ("Terms"), which may be updated as described in the "Changes to Terms" section. By using FameForecast, you agree to comply with the YouTube Terms of Service and the Twitch Developer Services Agreement, as applicable to your use of data from these platforms. If you do not agree to these Terms, you must not access or use FameForecast. Your use is also subject to our Privacy Policy.
FameForecast is an interactive entertainment platform that lets users spot clips with viral potential on platforms like YouTube and Twitch, using data from public APIs. Users can unlock game cards (FameCards and FameFiles) and join skill-based leaderboards based on analyzing which clips dominate in their first 24 hours live.
To access certain features, you must create an account and are responsible for keeping your credentials (e.g., username, password) confidential and for all account activities. Notify us immediately at contact@fameforecast.com of any unauthorized use or security breach. We are not liable for losses due to your failure to secure your account.
You agree to provide accurate, up-to-date account information. FameForecast reserves the right to suspend or terminate your account, with or without notice, for violations of these Terms, fraudulent activity, or behavior harming the platform or users.
FameCards are fun game cards—like Pokémon cards for streamers—unlocked through clip picks. Each card captures details of a user's pick, including the creator, platform, clip details, pick date, and baseline edge, serving as a deck starter celebrating your trend-spotting call.
Future Community Features: FameForecast plans to add deck-sharing tools for swapping FameCards with friends, focused on fandom fun and light-hearted trades.
Ownership and Use: FameCards are licensed to users for personal, non-commercial use within the platform. The Operator retains ownership of the underlying digital assets and may revoke or modify cards in cases of fraud, manipulation, or platform updates, with no obligation to provide refunds or replacements unless required by law.
1. Service Description: Hawkins Business Architecture Pty Ltd, as operator of FameForecast, facilitates paid media placements ("Slots") for creators to be featured in content produced by third-party hosts ("Host Creators").
2. No Guarantee of Results: While we guarantee that your content will be featured if your application is accepted and paid for, FameForecast makes no representation or warranty regarding the number of views, followers, or clicks you will receive. Performance depends on audience reception.
3. Voting Mechanics & Raid Eligibility: FameForecast utilizes a Split-Voting System to determine outcomes:
- Global Leaderboard: Calculated by total aggregate votes from all sources. This is a visibility metric only.
- Raid Winner: Determined EXCLUSIVELY by votes tracked via the Host's unique referral link ("Verified Host Audience").
You acknowledge and agree that having the highest total vote count on the Global Leaderboard does not entitle you to the Live Raid if you do not win the Verified Host Audience vote. Votes accumulated through external community sharing or "brigading" will not count toward the Raid prize.
4. Host Discretion: The Host retains final discretion regarding the Raid target for reasons of brand safety, technical stability, or timing. Being the vote winner makes you the primary candidate for the Raid, but does not constitute a binding legal obligation for the Host to transfer viewership if safety or technical issues arise.
5. Refunds: Payments are non-refundable once the Host has successfully aired the segment featuring your content. If a Host fails to perform the segment, you are entitled to a full refund or a rescheduled slot.
6. Content Standards: You warrant that any clip submitted for placement is your original work and does not violate the Terms of Service of the hosting platform (YouTube/Twitch/TikTok/Instagram). We reserve the right to reject any submission that poses a brand safety risk, with a full refund issued for rejected applications.
All content on FameForecast, including text, graphics, logos, FameCards, and software, is owned by FameForecast Pty Ltd or its licensors and protected by copyright, trademark, and other intellectual property laws. The platform is operated by Hawkins Business Architecture Pty Ltd under exclusive license.
Use of Platform Logos and Creator Images: Platform logos (e.g., YouTube, Twitch) and creator images are used under fair use or licensing agreements for informational purposes. These remain the property of their respective owners, and their use does not imply endorsement or affiliation.
User Content: By uploading content, you grant Hawkins Business Architecture Pty Ltd a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the platform.
Reporting Concerns: If you believe content infringes your intellectual property rights, contact us at contact@fameforecast.com for investigation and appropriate action.
You may not reproduce or distribute our content except for personal, non-commercial use as permitted by law (e.g., temporary browser caching, printing a single copy).
You agree to use FameForecast lawfully and not to:
- Violate any applicable laws or regulations.
- Send unsolicited promotions or spam.
- Impersonate others, including FameForecast staff or users.
- Harass, defame, or harm others (e.g., via abusive comments or false picks).
- Introduce malicious code (e.g., viruses, trojans).
- Use automated tools (e.g., bots, spiders) to scrape or manipulate data, unless explicitly permitted by FameForecast for specific, approved purposes.
- Attempt to manipulate clip pick outcomes (e.g., using bot accounts for creators or artificially inflating clip metrics).
Violations, including attempts to manipulate picks or clip/creator data, may result in account suspension, disqualification of picks, creators or clips, or voiding of rewards, at our sole discretion.
FameForecast hosts weekly skill-based leaderboards where participants spot clips with viral potential on platforms like YouTube and Twitch. Leaderboards are organized by Platform (YouTube, Twitch) and Creator Tiers (e.g., Micro, Mid-Tier, Established, Mega, Elite), with rankings based on a dynamic scoring system. This system evaluates your picks for clips within their first 24 hours live (from publication or effective start time). It calculates a "Baseline Clip Edge" tailored to factors like the clip's age at the time of your pick and the creator's follower count, with points awarded based on how your chosen clip performed against the baseline and competition.
Skill-Based Structure: Leaderboards require research and analysis of factors like a clip's content, the creator's typical audience engagement, early buzz (if applicable), overall platform trends, and objective, API-sourced metrics (e.g., current metrics, creator follower/subscriber counts). Success depends on analytical skill in spotting clips that dominate within a defined timeframe. Participants pick the clip with the strongest edge from the moment of selection until it completes its first 24 hours live.
Eligibility: To participate in weekly leaderboards and earn Seasonal Leaderboard points, users must make a pick on an eligible clip. Clips must be less than 24 hours old from their initial publication (for YouTube/Twitch Clips) or effective start time (for Twitch VODs, which is after the live stream ends and the VOD is fully available) when the pick is submitted, with no specific duration (length) requirement for the clips. Picks must generally be for clips from creators who meet a minimum follower/subscriber count (see tier definitions below) to be categorized into leaderboard Tiers. For a pick to count in the current weekly leaderboard (Monday 00:00 UTC to Sunday 23:59 UTC), the clip must complete its 24-hour lifecycle (from its publication or effective start time) and the pick must reveal (i.e., final score calculated) by Sunday 23:59 UTC.
Creator Tiers: Creators are grouped into tiers based on their follower/subscriber count at the time of your pick: Micro (0–9,999), Mid-Tier (10,000–99,999), Established (100,000–999,999), Mega (1,000,000–9,999,999), Elite (10,000,000+).
Fair Play: FameForecast may disqualify picks, users, or creators/clips involved in manipulative practices (e.g., bot accounts, artificially inflated follower/metric counts, exploiting system errors) to ensure fair competition. Disqualified picks may result in voided FameCards or rewards.
FameForecast is provided "as is" and "as available" for entertainment purposes only. We do not warrant the accuracy, completeness, or reliability of platform content (including API-sourced data which may be subject to delays or adjustments by the source platforms) and do not guarantee uninterrupted or error-free access.
To the fullest extent permitted by Australian law, Hawkins Business Architecture Pty Ltd (as operator of FameForecast), its affiliates, and licensors are not liable for any direct, indirect, or consequential damages arising from your use of FameForecast, even if advised of such damages. Our total liability shall not exceed AUD $100.00, unless required by law, including the Australian Consumer Law.
We may update these Terms at our discretion, effective immediately upon posting. We may notify you of significant changes via email or platform announcement, though we are not obligated to do so. Continued use after updates constitutes acceptance. Please review periodically.
We may discontinue FameForecast or any feature at any time, with or without notice. Upon termination, FameCards will not be refunded unless required by law. You may terminate your account by contacting us.
These Terms are governed by the laws of the State of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes arising out of or in connection with these Terms or your use of FameForecast, except where prohibited by applicable law.
